Swimming Pool Repair Service – Terms & Conditions (California)

1. Authorization to Perform Work
Customer authorizes Pool Systems Plus, a California licensed contractor, to perform swimming pool and/or spa repair, service, and installation work as described verbally or in writing. Customer represents they are the property owner or authorized agent.
2. Payment Terms
Payment is due upon completion of work unless otherwise stated in writing. Accepted payment methods include cash, check, and credit/debit card. A 3.5% processing fee will be added to all credit or debit card transactions. Master card not accepted
3. Late Payment & Finance Charges
Any balance not paid within 30 days shall accrue a late fee of 5% of the outstanding balance, applied every 30 days thereafter until paid in full, as permitted by California law.
4. Credit Card Authorization
Customer authorizes Pool Systems Plus to charge the provided card for all approved work and agrees not to dispute properly authorized charges. Any disputes with payments regarding refunds or cancellation of payments have to go be addressed with pool systems plus within 30 days of the payment date or job completion date.
5. Preliminary Notice & Mechanics Lien Rights
A contractor who is not paid may record a mechanics lien on the property. Pool Systems Plus may serve a Preliminary Notice as required by California law to preserve lien rights.
6. Warranty
Labor is warranted for 60 days. Parts are covered only by the manufacturer’s warranty. Warranty excludes chemical imbalance, misuse, neglect, acts of nature, or lack of maintenance.
7. Chemical & Water Condition Disclaimer
Pool Systems Plus is not responsible for damage caused by improper water chemistry or chemical misuse.
8. Change Orders & Additional Repairs
Additional work may be authorized verbally, electronically, or in writing and billed accordingly. Change orders will be billed separately unless other wise stated.
9. Limitation of Liability
Liability is limited to the amount paid for the service rendered. No incidental or consequential damages.
10. Mediation & Dispute Resolution
Disputes shall first be submitted to mediation in the county where work was performed before any legal action.
11. Cancellation & Access
Customer must provide safe access to equipment. Missed appointments may result in a service fee. If a requested service call or warranty call is not canceled withing 24 hours prior to the first hour of the scheduled appointment there is a service fee of $50.00
12. Acceptance of Terms (E-Signature & Click-Wrap)
By signing below, authorizing work, submitting payment information, or submitting a service request through the Pool Systems Plus website, Customer affirmatively agrees to all Terms & Conditions contained herein. Customer acknowledges this agreement is legally binding and enforceable to the same extent as a handwritten signature under the California Uniform Electronic Transactions Act (UETA) and the federal E-SIGN Act.
13. Website Check-box Acknowledgment
Customer must check a box stating: “I have read and agree to the Pool Systems Plus Terms & Conditions, including payment terms, late fees, credit card processing fees, lien rights, warranty limitations, and dispute resolution provisions.” Submission without checking this box is prohibited.
